In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), users are informed of the following:

Purpose of processing: to manage inquiries and requests made through the website; provision of services and/or compliance with legal obligations.

Legal basis for processing: the express and unequivocal consent of the data subject through acceptance of the corresponding informed consent clause; performance of a contract; or compliance with legal obligations.

Recipients: no data will be transferred to third parties except where legally required or necessary for the provision of a specific service.

Rights: Data protection regulations grant a series of rights to data subjects or owners of the data, users of the ALTA IP website. In particular:

– Right of access: the right to obtain information on whether their personal data is being processed, the purpose of the processing, the categories of data being processed, recipients or categories of recipients, retention period, and the origin of such data.

– Right to rectification: the right to obtain the rectification of inaccurate or incomplete personal data.

– Right to erasure: the right to obtain the erasure of data when:
  • The data is no longer necessary for the purpose for which it was collected
  • The data subject withdraws consent
  • The data subject objects to the processing
  • The data must be erased in order to comply with a legal obligation
  • The data has been collected in relation to the offer of information society services in accordance with Article 8(1) of the GDPR

– Right to restriction of processing: the right to obtain restriction of processing of data when:
  • The accuracy of the personal data is contested by the data subject, for a period enabling the company to verify the accuracy

  • The company no longer needs the data for the purposes for which they were collected, but the data subject needs them for the establishment, exercise, or defense of legal claims
  • The data subject has objected to processing pending verification of whether the legitimate grounds of the company override those of the data subject

– Right to data portability: the right to receive personal data in a structured, commonly used, and machine-readable format, and to transmit it to another controller when:
  • The processing is based on consent
  • The processing is carried out by automated means

– Right to lodge a complaint with the competent supervisory authority.

Users are also reminded of their right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos).

Retention period: The information collected from the data subject will be retained as long as necessary to fulfill the purpose for which the personal data was collected. Once that purpose has been fulfilled, the data will be canceled. Such cancellation will lead to the blocking of the data, which will be kept only at the disposal of Public Administrations, Judges, and Courts, to address potential liabilities arising from the processing, during the statute of limitations period. After this period, the data will be destroyed.
